Bipartisan Compromise Takes Shape

A bipartisan push to toughen the ethics provisions inside the Digital Asset Market Clarity Act has reached a new milestone. The two senators working on a compromise to satisfy all sides in the crypto CLARITY Act's ethics push have finalised their approach, according to sources, though the details have not yet emerged publicly. Senator Thom Tillis and Senator Ruben Gallego took on the task together and have indicated they have struck new common ground.

The ethics provisions in the updated CLARITY Act would bar senior federal officials, including the president, from issuing or sponsoring digital assets while in office, and give the Department of Justice exclusive authority to enforce the rules. That language takes direct aim at President Trump's extensive crypto business interests. The conflict-of-interest piece, which would include limits on Trump's own widespread crypto involvement, has been a major final point of contention in the legislation.

Time Running Out Before August Recess

White House approval and broader Senate Democratic sign-off remain outstanding before the bill can advance to a floor vote. Democrats have dismissed earlier versions of the language, saying they cannot support rules that leave enforcement exclusively to the DOJ. The bill needs 60 votes in the Senate to clear cloture. Republicans hold 53 seats, but Senators Josh Hawley and Rand Paul are expected to vote no, meaning roughly nine Democratic votes are required.

Crypto industry lobbyists are watching closely because time is running out before the Senate breaks for its August recess, and the bill almost certainly does not have enough time to complete the Senate's full multi-stage process before the break. But if it were to clear an initial 60-vote hurdle before the end of the week, that could be enough to put it on a winning path. To give that possibility its best chance, the industry wants Senate Majority Leader John Thune to file the first cloture motion before the week is out.

Multiple analysts, including Beacon Policy Advisors and Galaxy Research, have identified the August recess as the last realistic gate for 2026 passage. If the bill misses it, the political dynamics of the midterm election calendar make passage before 2027 substantially less likely.
