The Digital Asset Market Clarity Act is facing fresh Republican opposition, with Senator Josh Hawley (R-Mo.) declaring he will vote against the bill unless it is amended to better protect community banks from stablecoin-driven deposit flight.

Hawley Warns on Agricultural Lending Risk

Hawley says banking and agriculture groups in Missouri are "very, very worried about the effect on community banks," according to Politico. His specific concern is that yield-bearing stablecoins could draw deposits away from smaller lenders, undermining their capacity to fund agricultural and local business lending. Community banks rely heavily on customer deposits for lending and operations, and a shift of funds into yield-bearing stablecoins could undermine their financial stability.

Hawley is not alone. Senator Rand Paul (R-Ky.), the only other Republican to vote against the $GENIUS Act, is widely expected to oppose this bill as well. The number of Republican lawmakers who are hesitant about the CLARITY Act could be as high as five, according to reports, making vote-counting increasingly difficult for leadership.

The banking industry has been raising similar alarms for months. The American Bankers Association, Bank Policy Institute, Independent Community Bankers of America, and several other groups warned that allowing interest-like yield on stablecoins could weaken bank deposits and reduce credit available to consumers, small businesses, and farmers. The core concern is whether allowing yield on stablecoins will encourage deposit flight from community banks, raising funding costs and shrinking lending capacity. The Independent Community Bankers of America has projected that $1.3 trillion in displaced deposits and $850 billion in reduced lending capacity could result if Congress fails to close the loophole.

A 60-Vote Threshold With Shrinking Room for Error

The bill needs 60 votes and Republicans hold 53 seats, leaving sponsors hunting at least seven Democrats, who have not yet been secured. On the left, seven Democratic negotiators said the July 22 draft fell short, and talks over a government ethics provision restricting senior officials' digital asset dealings collapsed in late July. That dual-front pressure, from both Republican holdouts on community bank protections and Democrats on ethics language, has put the bill in a precarious position.

On August 3, Senate Majority Leader John Thune told reporters the bill would get a floor vote before the August recess, but the arithmetic remains difficult. The crypto bill is hardly guaranteed to muster even a majority, as some Republican senators have raised concerns with its treatment of stablecoin yield and the language of the government ethics provision. If the vote is delayed past the recess, the bill's prospects for 2026 dim considerably.
