Senate Kicks Crypto Bill to September

The U.S. Senate has delayed its vote on the Digital Asset Market Clarity Act, a key piece of crypto market structure legislation, until September, ending any chance of passage before the August recess. Senate Majority Leader John Thune pushed the vote to September, according to Politico senior congressional reporter Jordain Carney.

The Clarity Act, which has already passed the House, aims to delineate jurisdiction over digital assets between the SEC and CFTC. Republicans hold 53 Senate seats, but the bill needs 60 votes, requiring support from at least seven Democrats. Democrats are refusing to agree to a timetable, saying more talks are needed over ethics provisions and yield payments.

Narrow Window and Rising Political Risk

A September vote pushes the decision into a session already crowded with appropriations fights ahead of the November midterms, reducing available floor time and adding execution risk to the bill's prospects for 2026 passage. The main sticking point remains the ethics provision barring top U.S. officials, including President Trump, from supporting or participating in crypto projects. Trump agreed to a compromise, but Democrats say the restrictions do not go far enough.

Some details of the Clarity Act itself are still being negotiated, including provisions addressing illicit finance and agriculture issues, not to mention the ethics provision aiming to block senior government officials like President Donald Trump from profiting off of the crypto industry.

Prediction market odds for the bill's passage this year have declined, falling to 15.5% from 18% just a day prior, and down from 30% a week ago. The postponement removes near-term regulatory clarity for digital asset markets, extending uncertainty that firms have cited as a constraint on custody and product planning since the bill cleared committee in May.
