Saylor Backs the Bill, but Says Bitcoin Will Win Either Way

Strategy (@MicroStrategy) Chairman Michael Saylor (@saylor) offered a pointed take on the stalled Digital Asset Market Clarity Act this week, saying the legislation matters not for Bitcoin's survival, but for America's competitive position. "Bitcoin will succeed with or without legislation, but America needs clarity for digital assets," he wrote.

Saylor expressed support for the CLARITY Act, calling for its swift passage to establish clear and durable rules, protect property rights, and strengthen US capital markets. Strategy Inc. (Nasdaq: MSTR), the world's largest corporate bitcoin holder, added its name to the legislative campaign on July 31.

Senate Pushes Vote to September

Senate Majority Leader John Thune confirmed through a spokesperson that there would not be a vote on the CLARITY Act in August, but that there would be one next month. The Senate will return to Washington on September 14, 2026, and will have three weeks to work on the bill and other outstanding issues.

The delay stems largely from Senate Democrats declining to agree to a time agreement that would have sped up floor business and cleared a path to a vote. Democrats opposing the bill focused criticism on a government ethics section tied to President Trump's crypto activities, with every hour of floor time described as a precious commodity at this stage of the Senate calendar.

The bill aims to establish clear regulatory guidelines for digital assets and has been closely watched by industry stakeholders and lawmakers alike. The legislation would split crypto oversight between the SEC and CFTC and has backing from Wall Street heavyweights including BlackRock, Fidelity, and Goldman Sachs. The House passed the Digital Asset Market Clarity Act as H.R. 3633 on July 17, 2025, by a vote of 294 to 134, with every Republican and 78 Democrats voting in favour.

Polymarket currently puts the probability of CLARITY Act passage in 2026 at 33 to 37 percent, down from above 80 percent in February. If the vote slips deeper into September, the debate will move closer to the midterms, when lawmakers have less time and appetite for major legislation. Even if the Senate approves, the bill must pass the House again before reaching the president's desk.
